Terms of Use

All BeatPhoria sample packs (unless explicitly stated) are 100% royalty free for both, selling beats online and independent with the EXCEPTION of placements with major artists and labels. (See Below)

1) Independent Releases:

You may use the Sample for Recordings on your own personal projects, independent releases, beat tapes, selling beats online and mix tapes that are not distributed or released via a "Major Label" (i.e., SonyBMG, UMG, WEA, or their subsidiaries) or "Large Indie Label" (i.e., Alamo, Empire, 300, E1 or comparable label) at no additional cost (including, for the avoidance of doubt, without providing us with publishing splits), provided that any Minor Release that exceeds one million streams on Apple Music, Spotify or YouTube shall be considered a Major Release for purposes of this license and shall be subject to the below terms for Major Releases.

2) Major Releases:

You may use any sample solely for recordings on your own personal projects which are distributed solely by you independently (i.e., beat tapes or mixtapes) without any additional obligation to us or the Sample owner other than the License Fee as provided above, provided that in the event that any Recording exceeds One Million (1,000,000) streams across Apple Music, Spotify and YouTube, you shall be required to immediately obtain formal clearance of the Sample for use in the Recording pursuant to procedure outlined below.

For Recordings to be distributed or released via a Major Label or Large Indie Label, or any Minor Release that exceeds one million streams on Apple Music, Spotify or YouTube (each such release, a "Major Release"), you shall be required to:

(a) Contact us promptly (beatphoriasounds@gmail.com) to seek clearance for use of the Sample on a Major Release;

(b) Provide for a 50/50 split of any Advances, Producer Royalty and Publishing, including for the avoidance of doubt, in relation to any so-called 'synch licenses';

(c) Provide us/the creator of the applicable Sample with Co-Producer credit on the liner notes of any singles or albums (in any configuration), in advertisements, and wherever metadata permits

You are required to give BeatPhoria Sounds production credit for any major artist or major label that is released or published using our samples, without exception.

Refunds:

All purchases are final and no refunds may be issued under any circumstances.

BeatPhoria Sound forbids resale or lease or share of any purchased products and inclusion of content contained within our products, into other sample pack, or library of any kind.

All of our products are licensed, but not sold to our customers. BeatPhoria Sounds retains full copyright and ownership to all recorded sounds included in our products.

All bundles and discounted prices apply only to the product line at the time of purchase.
